  • (EN) Reforma súdnictva v Slovenskej republike: Najvyšší správny súd

    Po vzore českého Nejvyššího správního soudu sa aj slovenská justícia dočkala podobnej inštitúcie. Najvyšší správny súd (ďalej aj „NSS“), z dielne ministerky spravodlivosti Márie Kolíkovej ako súčasť reformy súdnej mapy, formálne vznikol na základe novely Ústavy Slovenskej republiky (ďalej len „ústava“) ústavným zákonom č. 422/2020 Z. z. , a na základe zákona č. 423/2020 Z.z. o zmene a doplnení niektorých zákonov v súvislosti s reformou súdnictva. V praxi by mal NSS začať fungovať od augusta 2021. NSS na základe hierarchie súdov v Slovenskej republike bude rovnocenný s Najvyšším súdom Slovenskej republiky (ďalej len „najvyšší súd“) a preberie po ňom oblasť správneho súdnictva.

  • Case law of Court of Justice of the EU – Jurisdiction under Brussels I bis Regulation

    By the judgment in case C-451/18 Tibor-Trans Fuvarozó és Kereskedelmi Kft. proti DAF Trucks NV of 29 June 2019, the Court of Justice of the European Union (“Court”) confirmed and extended its previous case-law regarding the establishment of jurisdiction pursuant to Regulation (EU) No 1215/2012 of the European Parliament and the Council of 12 December 2012 on jurisdiction and the recognition and enforcement of judgments in civil and commercial matters (“Brussels I bis”). The question referred for a preliminary ruling concerned the interpretation of Article 7(2) of Brussels I bis Regulation.

  • DO YOU HAVE AN E-SHOP? THE PROHIBITION OF THE SO-CALLED GEO-BLOCKING FROM 3 DECEMBER 2018 COULD BE OF INTEREST TO YOU

    In practice some operators of predominantly smaller e-shops prevented customers from abroad from accessing the online shop and purchasing goods in it. Their motivations for this approach vary and they may include, for example, a different legal environment, legal uncertainty caused by it, risks associated with different consumer protection rules, different laws concerning identification, taxation, delivery costs etc. Therefore, some e-shops logically decided not to deliver abroad and to eliminate in such a way a possible legal risk.In order to preserve and fully use the potential of the internal market without internal borders, the European Union (EU) decided to react to this practice by a new regulation, which perceives it as unjustified geo-blocking and seeks to prohibit this discrimination of customers.
